David is a deaf man in his 60s with intellectual disabilities. After more than 30 years at the same job, his paychecks began to shrink. His sister Brenda did her best to advocate for him, but she realized she needed help. The problem started when the company David worked for was acquired by a major corporation. Brenda noticed the change in his paychecks. David’s supervisor said they didn’t have enough work to keep him busy. But when Brenda came by to check on him, David was always working. When Brenda and David requested back pay for hours worked, the company offered to pay significantly less than what was owed. Brenda contacted Legal Aid’s Minnesota Disability Law Center. Legal Aid’s attorneys recognized this as wage theft. They first tried direct contact, but the company’s representatives would not negotiate. Legal Aid filed a lawsuit alleging minimum wage violations under federal and state law. The company’s attorneys finally entered negotiation and ultimately paid David all that he was owed. “David earned the money and they weren’t going to pay him,” says Brenda. “The corporation ghosted me. I was so frustrated. Legal Aid treated the case as seriously as I did, and they didn’t back down.
