< PreviousA TT ORNEY OF THE MONTH HEATHER Gammage & Burnham has been my home. I’ve been with this firm my entire career.”eather Boysel’s star is definitely on the rise. She not only enjoys the distinc- tion of being the first female managing partner of Gammage & Burnham, the Arizona law firm established in 1983 by Grady Gammage, Jr., Richard Burnham and Michael King, but at just 37, she’s also one of the youngest. And, joining an elite circle of female managing partners at Arizona law firms, Boysel was recently named by the Phoenix Business Journal to the 40 under 40 of 2019. Based on her obvious success, one might surmise that Boysel had her eye on law from a young age. In fact, medicine was her original career path, but somewhere along the way her father and sister-both physicians themselves- persuaded her to rethink that trajectory. Based on the amazing law career she’s established at such a young age, that has proven to be some pretty sound advice that surprisingly, has also brought her full circle. “My dad moved into the billing side of his practice, so I worked for his medical billing company while in high school and college,” Boysel clarifies. “I helped by writing demand letters to insurance companies, and so in a way I actually ended up going into the fam- ily business because now I practice healthcare law, primarily helping providers with reim- bursement issues.” Those years she spent immersed in the study of biomedical engineering however are far from wasted, as Boysel finds that knowl- edge and background serve her well in her thriving practice. “It’s nice because I still get to utilize my sci- ence background to a certain extent since I’m reviewing patient’s medical records to figure out how the claim should be reimbursed, the severity of the patient’s care, what diagnoses are appropriate and things like that,” she says. A GREAT FIT The summer prior to completing law school Boysel clerked at the highly reputed firm where she now presides as managing partner. With Gammage & Burnham’s excellent repu- tation in the healthcare field in Arizona, it was a natural segue for her to opt to begin her ca- reer with them. And, as they say, the rest is history. “Gammage & Burnham has become my home. I’ve been with this firm my entire ca- reer,” Boysel says proudly. “It’s been a really great fit for me. I made partner in 2015 and became the managing partner in June.” Admittedly, this new position and the re- sponsibilities that accompany it have im- pacted Boysel’s day-to-day routine, but she’s obviously not only well-suited but seems to be enjoying the new duties. The announcement of her recent appointment has also resulted in an avalanche of communications from fellow female attorneys and hopefuls who want to connect, share experiences or ask advice. “Once the press releases began going out about me being made managing partner, the engineering school at ASU reached out and did a piece on me,” she says. “It was nice to reconnect with the program and talk to some of my former classmates. Also, ASU’s Wom- en’s Law Students Association reached out. I get emails from women who either want to go into law or who are currently in law school, just wanting to talk and hear about my path. “ Gammage & Burnham has been my home. Co- founded by attorneys Beth Fitch and Allison Christian, this one-year pro- gram offers direct training and career development through a combination of coaches, sponsors and participants to empower women attorneys in an attempt to close the still-present dis- parity between how male and female attorneys are perceived, treated and compensated. “Ladder Down is an amazing pro- gram in which I’ve had the pleasure and honor to have participated in over the years,” says Boysel. “They provide you with business development train- ing, leadership training and you really get to know a group of other female attorneys who may not practice in the same areas, but it builds a sense of collegiality and we provide support to each other. “The name Ladder Down comes from circumstances when people make it to a pinnacle and then pull the ladder up behind them,” she adds. “The goal is for us to continue to send the ladder down to bring more fe- male lawyers up through the ranks. In many ways the legal profession has trended a bit behind the times. When you look at most firms, people at the top still tend to be the older men.” LIVING LEGAL Within her relatively short career, Boysel has distinguished herself in a variety of arenas. As an experienced commercial litigation attorney with an emphasis in the healthcare field, she has successfully obtained mil- lions of dollars in payments owing to providers by health care insurers. She routinely handles medical reimburse- ment disputes on behalf of providers against commercial payors, Medicare auditors, AHCCCS contractors and other governmental entities. Her extensive knowledge of the legal protections and intricacies of healthcare payment methodologies and healthcare provider liens, to- gether with her background in bio- engineering and medical billing fur- ther fuels her fluency in representing healthcare providers with reimburse- ment issues through administrative hearings, mediations, arbitrations and court actions. “We work on some really exciting things,” she says. “In my early career I enjoyed a more general commercial litigation practice. For example, dur- ing the economic downturn, I did a lot of work for lenders. It was re- ally good experience and we enjoyed some great victories. Beyond that, her expertise also ex- tends to litigating other commercial matters including construction, real estate and other business disputes. Boysel also brings to the table a wealth of experience related to election law and government and public affairs. “Also, early on I worked on numer- ous election law cases, which was exciting and fast-paced,” she says. “Those cases move up through the court system extremely quickly. They are also typically high profile and very interesting to work on. But, at the end of the day my heart was really in the healthcare arena. Certainly, as I’ve become busier with other things, I’ve really tried to focus on the healthcare practice.” In fact, about one year ago, Boysel became the chair of the firm’s health- care group, which represents several Arizona hospitals. “Managing all that and helping to build the team, definitely keeps me busy,” she says. “We actually just had a new attorney, Ben Runkle, start re- cently who will be working in health- care law with me. He also has a wealth of experience in healthcare law—he actually started his career working on the opposite side of cases with me.” It turns out Boysel and Runkle have not only the practice of healthcare law in common, but both have children the same age and in the same school and same grade. “It’s fun, because I get to think about who I’d like to work with as a law partner long term and Ben fits the bill perfectly,” she adds. One of the things that Boysel hopes to maintain about Gammage & Burnham’s culture is its family-like environment. GROWING STRONGER “We’re really looking to bring in more new talent strategically at this point,” says Boysel, now wearing her managing partner cap. “I don’t think we ever want to get too large; the 30 to 50 lawyer range feels about right to maintain the culture we’ve created. Of course, we have people who will be retiring over the next five to 10 years, so we’re certainly looking bring in attorneys with the right expertise to continue Gammage & Burnham for generations to come. I think we have a solid foundation, from our culture and quality of work to the clients we have. It was nice to step into some- thing that’s so well-built. “I THINK WE HAVE A SOLID FOUNDATION, FROM OUR CULTURE AND QUALITY OF WORK TO THE CLIENTS WE HAVE. It was nice to step into something that’s so well built.” Joining the team of experienced at- torneys during this expansion are Ju- lie A. Pace, David A. Selden and Heidi Nunn-Gilman, who have been work- ing as a team for over fifteen years. Associates Demetra Makris and Dan- iel Marks and paralegals Eda Barroli and Stephanie Coulter are also com- ing aboard. “Julie Pace is the head of that group,” notes Boysel. “She’s very well- known within the legal community, and a very qualified employment law attorney. “Heidi and of course associates Demetra and Daniel and paralegals Eda and Stephanie, are all tops in the field so we’re very excited to have them all join our team,” she adds. “Of course, my challenge is where to put everyone!” ON THE HOME FRONT As anyone in the legal profession knows only too well, balancing pri- vate and professional time can be a struggle. Boysel has certainly faced this hurdle but says that with the sup- port and help of her husband Jason and the family-friendly culture of her firm, she’s finding a way to make it all work. “I have two young daughters, and raising a family can make practicing law somewhat difficult at times,” she says, “but our firm has been good about work/home balance and allow- ing people to have a life outside the office while still providing excellent client service.” Boysel and her husband are the parents of two delightful daughters, Violet who is 8 and Lily now 5. If you detect a particular theme here, you’re not wrong. “We are a floral family,” Boysel says with a laugh. “Most people don’t re- alize that heather is a flower, but I decided to continue the theme when naming my daughters. And just to top it all off, we live on Orchid Lane!” And while certainly having a young family keeps life busy and interest- ing, Boysel says with the girls now in school life has become a bit more manageable. 13GAMMAGE & BURNHAM 2 N Central Ave 15th Floor Phoenix, AZ 85004 (602) 256-0566 www.gblaw.com “We’re at the fun stage now, no more diapers and they are much more independent, which makes it much easier to get out of the house in the mornings,” she says. “My husband and I have a pretty good bal- ancing act going. I have morning duty-getting the girls ready and off to school and he does the afternoon pickup. “Jason owns a general contracting firm,” she adds, “so we’re both plenty busy especially with my expanded duties, but he’s really stepped up and he’s always been my greatest supporter.” Not surprising in a household with two young children and two very demanding professional careers, there’s not a lot of time for lei- sure or hobbies. “It might sound weird,” Boysel says with a soft chuckle, “but my only real hobby is planning family vacations. I spend a lot of time carefully planning any trips that we take. It’s sort of my extra-quality time with my kids. Actually, they’re kind of spoiled, because when I was a kid, we used to go to Kansas every year and drive for two days in a car. “We’ve taken our girls to Ireland, last year to the Netherlands and next year we’ll be taking them to France. The key is to separate myself from my laptop and create some real memories.” Her life is both abundant and busy, but Boysel wouldn’t change a thing. As she puts it, “You know that old adage, the grass is always greener? In an age of quick service and automation, people are feeling an increased need to be heard. They are missing that personalized service that goes above and beyond – it’s time to do what you can to bring it back. IMPROVING THE CUSTOMER SERVICE YOUR LAW FIRM PROVIDES Your clients will gravitate towards the person who makes them feel the most comfortable with their case, keeps them informed, and speaks to them at a human to human level. The first place to start when upping your customer service ante is by making sure that you are keeping your client in the loop with every step. Received their inquiry on your ser- vice? Automate an email to let them know what to expect from your firm. Completed their client intake? Send a recap and timeline of the next events. Working on their documents? Have your assistant reach out to let them know about their progress and when they will hear from you next. Com- municate every detail so that your clients understand the (sometimes) scary legal processes. This makes cli- ents more comfort- able with you, but also saves you time and headache later when they aren’t blowing up your phones for answers. TAKE YOUR COMMUNICATION ONE STEP FURTHER. A large part of customer service is proving that your clients can trust you. To do this, you need to go over the top with communication, organi- zation, and professionalism. Do you answer the phone with “Hello?” or is it more like “Thank you for calling ___ Law Office, how can I assist you?” Answer this: Which one would you be more likely to trust? Set a process in place that everyone who answers the phone must follow. I call this a Call Flow Blueprint and create one for every law firm we work with. Start by asking yourself the fol- lowing questions, then put them all down to paper. • What types of calls would you like immediately transferred to your of- fice? • How soon will you handle client messages? • Can your receptionist relay quick details on their case to provide the client with some instant gratifica- tion? • What about a timeline process that you follow so that your clients can know exactly what stage they are in and what to expect going forward? • Is your payment schedule easy to understand? • How do you handle scheduling for potential new clients? What about follow up appointments for existing clients? It’s a lot of work to keep your or- ganization in check and instill trust through your communication. But your clients will thank you for it, and to be honest, so will your bank ac- count. WHAT CAN YOU DO PAST SIMPLE COMMUNICATION? A law firm isn’t a fruity place where you can offer cucumber mint water in the waiting room. Or is it? No- body wants to need your service. If anything, they hope to avoid needing to speak to a lawyer forever. Sorry to say it but you are right there with the dreaded auto mechanic - people don’t want to have to need you. Since they do need your service and are probably unhappy about it, the least you can do is make it a more enjoyable place to spend an afternoon. Pull out the cu- cumber mint water, keep the maga- zine stack updated, and have some enjoyable music playing in the wait- ing room. Do what you can to make your clients feel better about needing you before they even step into your office. THE MOST IMPORTANT STEP TO STELLAR CUSTOMER SERVICE IN YOUR LAW FIRM. You’re communicating and you’ve freshened up your office; what’s left to create a stellar experience for your clients and potential clients? RELENTLESS FRIENDLINESS Negativity spreads like wildfire through social media and it is the fastest way to get bad press for your firm. Stand out instead by: • owning up to your mistakes • asking for documents or needed in- formation nicely • apologizing when you are wrong • smiling when you speak • checking to be sure that your word- ing is coming across as friendly as possible Be professional but also allow your clients to view you as someone on their side. Friendliness, compassion, and understanding are the key. While they often do not get the publicity of large firm cyber breaches, mid-sized and small law firms are not at all immune from this phenomenon. In fact, cybercriminals often consider mid-sized and small firms attrac- tive, vulnerable “weak links,” given: (1) their relative lack of sophistica- tion in using technology to protect confidential information; and (2) the information they may possess, such as confidential information about cases, client information, privileged communications and attorney work product, and personally identifiable information for employees, clients, and third parties. Recent studies indicate that a quar- ter of all law firms have suffered cy- berattacks. The consequences of cybercrime are significant, including: business in- terruption from losing access to work product and documents; incurring substantial costs to regain access and repair damaged systems; payment of ransom to cybercriminals; and mal- practice, ethics, governmental, and other third party claims arising from data breaches. REDUCE THE RISK Law firms need to use every tool at their disposal to avoid becoming the victim of cybercrime in the first place. Steps to avoid cyber-attacks in- clude: requiring encryption of all confidential information; using cloud computing software with safeguards in place; using strong passwords in computers and other devices; using web-based client portals instead of email to share sensitive information; using strong intrusion detection and counter-espionage software; having up-to-date written policies addressing cybersecurity; and providing regular, effective user education on firm poli- cies and procedures, risks, and trends. Taking such steps will not only re- duce the risk of cybercrime but can reduce the cost of cyber insurance premiums. EFFECTIVELY INSURE AGAINST CYBERCRIME Even with careful and thorough protections in place, firms also need to protect themselves by having prop- er insurance coverage in place in case they are nevertheless victimized. Cy- bercrime is usually hard to detect and prevent, and the financial cost can be devastating. Firms often mistakenly believe they are adequately covered by their existing general liability and malpractice policies, only to discover – too late – that they will not in fact cover many of the substantial costs resulting from cybercrime. Business interruption commonly results from computer hacking. The cost to any firm of having to shutter its business for any significant period of time – while forensic analysis is done to identify the problem and then restore the system – is substantial and could potentially threaten the finan- cial life of the firm. General liability policies may not insure business in- terruption losses caused by cyber- attacks. Another growing type of cyber-at- tack is the ransomware attack. When ransomware software is hacked into a firm’s system, the firm can be com- pletely locked out of its own computer system including, for example, time and billing. Law firms and other enti- ties (including governmental entities) regularly pay cybercriminals substan- tial sums to delete their ransomware and return control to the firm, an ex- pense unlikely to be covered under a general liability policy. While cyber insurance policies are not yet standardized in what they cov- er, they may cover costs that would not exist under the firm’s other insurance coverages, including: Legal fees, the cost of computer forensics to identify the cause and solution, and the ex- pense of notifying affected third par- ties of a data breach; Ransom money paid to stave off the threats made in ransomware attacks and to return control of the computer system; Loss of income and the cost to regain lost data and restore business operations; Loss of money or securities stolen in cyber-attacks; and Liability to third parties for unauthorized access to their data or failure to provide notifi- cation of the data breach, and for gov- ernment/regulatory claims. Many insurers offer risk-manage- ment resources to prevent attacks from happening and to respond to them effectively. UNDERSTAND YOUR COVERAGES Since cyber policies are relatively new, the coverage they offer can vary significantly from insurer to insurer. It is important to understand the risks your firm faces (to avoid under or over-insuring), the coverages af- forded under your existing general liability and other policies, and how those coverages interplay with the cy- ber policies you are considering. An experienced insurance bro- ker can make a difference in helping to identify the best policy for your needs.
